Privacy Notice pursuant to Art. 13 of Legislative Decree 196/03
The “Data Controller”.
Pursuant to Art. 13 of Legislative Decree 196/2003, Personal Data Protection Code, La Spezia Yachting Service s.r.l. (hereinafter also referred to as: “Company” and/or “La Spezia Yachting Service”), with its registered office at Via Gozzano 17, 19032 San Terenzo, La Spezia – Italy, is the Data Controller, pursuant to Art. 28 of Legislative Decree 196/03, for the processing of your personal data. The Company informs you that the personal data collected, including those related to existing and/or future commercial relationships, are processed in compliance with the aforementioned legislation. In relation to the aforementioned processing, the Data Controller provides, among other things, the following information.
Data processing location.
La Spezia Yachting Service s.r.l., with its operational headquarters at Via Gozzano 17, 19032 San Terenzo, La Spezia – Italy.
Types of data processed.
Personal and identifying data as defined by Art. 4 letters b) and c) of Legislative Decree 196/03, as well as those related to any information about a natural person, legal entity, public administration, or any other entity, association, or organization responsible for periodically backing up databases, identifying data, traffic data, and anonymous data. This also includes browsing data, computer systems, and software procedures that acquire personal data during the website’s normal operation, whose transmission is implicit in the use of Internet communication protocols. This information is not collected to identify users, but it may, by its nature, allow users to be identified through processing and associations with data held by third parties. This category of data includes the IP addresses or domain names of computers used by users connecting to the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the server’s response (successful, error, etc.), and other parameters related to the user’s operating system and IT environment. These data are used solely for statistical purposes to ensure the correct operation of the site and are deleted immediately after processing. The data may be used to ascertain responsibility in the event of potential cybercrimes against the site.
Optional provision of data.
Except for browsing data, the user is free to provide personal data in the request forms or otherwise indicated in the “Contact” section to request the sending of informational material or other communications. Failure to provide them may result in the inability to fulfill the request, as better specified below.
Purpose of the data processing.
The purposes of processing personal data are as follows:
- Execution of existing and/or future commercial relationships with you;
- Compliance with legal obligations related to the aforementioned commercial relationships;
- Organizational management of any existing and/or future commercial relationships, provided they are connected to the corporate purpose of La Spezia Yachting Service s.r.l.;
- Protection of contractual rights;
- Internal statistical analysis to examine consumption habits or choices;
- Marketing activities through the sending of informational, advertising, or promotional material related to products or services derived from and/or similar to those covered by the existing commercial relationship;
- Tracking of activities for analysis purposes, saving user preferences and/or credentials;
- Sending newsletters related to the products and services provided by the Data Controller.
Data voluntarily provided by the user.
The optional, explicit, and voluntary sending of emails to the addresses indicated on this site involves the subsequent acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data included in the communication. Specific summary information will progressively be shown or displayed on the pages of the site designated for particular requested services.
Duration of processing.
The data will be processed for the duration of the ongoing commercial relationship and for the following ten years from the date of acquisition. It is understood that, unless otherwise indicated by the Data Subject, such data will still be deleted from the server upon the expiry of the tenth year.
Cookies.
Cookies consist of a small amount of textual information sent to your computer, stored in the user’s web browser directory when visiting a website. The purpose is to record, but also sometimes track, information related to the site’s usage experience. They are used to improve navigation from one page to another, save user preferences already entered (username, password, etc.), and track user tastes and preferences, allowing for the management of targeted marketing initiatives. If restrictions are placed on their use, this will likely impact the user’s experience during browsing. Blocking or removing them from the browser cache may result in incomplete use of the services offered by the web application. The site may use third-party cookies that allow information about visitors, keywords used to reach the site, and websites visited to be collected; in this case, the Cookies Privacy Policy can be viewed at http://www.yachting-service.it/cookies-privacy-policy/.
Data processing methods.
Personal data will be processed in paper, computerized, and telematic form and entered into the relevant databases, which may be accessed, and therefore become known, by the operators specifically designated by the Data Controller as Data Processors and persons in charge of processing personal data. These operators may carry out consultation, use, processing, comparison, and any other necessary operation, including automated operations, in compliance with the legal provisions necessary to ensure, among other things, the confidentiality and security of the data, as well as the accuracy, updating, and relevance of the data in relation to the purposes declared.
Data collected.
The data collected mainly relate to identifying data (company name or trade name, or name and surname of natural persons, address, telephone, fax, email, tax data, etc.) and data related to economic and commercial activities (e.g., order collection, signed contracts, competitions, solvency, bank and financial data, accounting and tax data, etc.). These data are provided directly by the Client/Data Subject or may be collected from third-party independent Data Controllers and/or external Data Processors on behalf of La Spezia Yachting Service s.r.l. The data collected may, in some cases, be sensitive and/or judicial in nature. In such cases, they will be processed in compliance with the legal protections and in accordance with Art. 23 of Legislative Decree 196/2003.
Nature of the provision of data.
The provision of data and its processing is mandatory concerning the purposes listed in points 1, 2, 3, 4, 5, and related to the performance of commercial obligations. As a result, the refusal to provide data for such purposes may prevent the Data Controller from proceeding with the contractual relationships and legal obligations. The provision is optional concerning the purposes outlined in points 6, 7, and 8, which refer to the execution of the main marketing activities initiated by the Data Controller and/or personnel research, the tracking of activities for analysis purposes, saving user preferences and credentials, and the sending of newsletters.
Scope of communication and dissemination of data.
In relation to the purposes indicated, the data may be communicated to the following subjects and/or categories of subjects listed below, or they may be communicated to companies and/or individuals, both in Italy and abroad, who provide services, including external services, on behalf of the Data Controller. Among these, for clarity, we indicate: • Companies that collaborate with La Spezia Yachting Service s.r.l.; • Companies associated with or connected to La Spezia Yachting Service s.r.l.; • Financial administrations and other companies or public entities in compliance with legal obligations; • Competent authorities and/or supervisory bodies for the fulfillment of legal obligations; • Companies and law firms for the protection of contractual rights; • For purposes 3, 4, 5, and 6, the data may be communicated to qualified individuals who work for the Company, as well as contractors, freelancers, and contracting companies; • The transmission of personal data abroad is provided for both EU and non-EU countries. (*) The list of External Data Processors with further identifying data is posted on a bulletin board inside the Company, accessible to the public.
Rights of Data Subjects
In relation to the above processing, you may exercise your rights under Art. 7 of Legislative Decree 196/2003, such as: • Obtain confirmation of the existence or otherwise of data concerning you; • Know the origin of the data, the logic, and the purposes on which the processing is based; • Obtain the deletion, anonymization, or blocking of data processed in violation of the law, the updating, correction, and integration of the data itself; • Oppose, for legitimate reasons, the processing of the data itself; within the limits and under the conditions provided for in Articles 8, 9, and 10 of the aforementioned legislative decree, by contacting La Spezia Yachting Service s.r.l. at Via Gozzano 17, 19032 San Terenzo, La Spezia – Italy, by calling +39 348 4253781, or by sending an email to info@yachting-service.it. Further information regarding the processing and communication of data provided directly or otherwise acquired may be requested from the Data Processing Manager, Nico Amodei, at the Company’s headquarters. The present notice naturally does not exclude that additional information may be provided orally to the data subjects at the time of data collection. Viewing this notice is understood to constitute express consent to the processing of your personal data under Art. 23 of Legislative Decree 196/03. It remains understood that such consent is, in any case, conditioned upon compliance with the provisions of the applicable legislation.
